Below is a list of just some of the many legal
    claims workers may have under Connecticut
    and federal law. Entities subject to these laws
    include employers. This may include someone
    you think you are "just a contractor" of,
    employment placement agencies, "temp" firms,
    and labor unions.

    You may have one or more of these claims, but
    be aware that they each have different statutes
    of limitations -- the time limit for suing in
    court, or filing a "Charge of Discrimination"
    with state and federal agencies, or a claim against the State or
    federal governments, and if you are suing a town,
    the State, or the federal government, you also have
    to give a Notice to the town or federal government
    before you can even go to court. These deadlines
    range between as little as 30 days, to 180 days, 1 year, 2 years,
    3 years, and at most, 6 years after the wrongful conduct
    occurred, depending on which legal claim or law is involved.
    Except for a few rare exceptions the courts allow, if you fail
    to meet these deadlines, your claim is lost forever, generally,
    even if your employer or union told you about them!

    And don't make the mistake of assuming that all lawyers are
    competent and experienced in this complex and evolving area
    of the law! If you think you might have any of the following
    claims, you need an immediate evaluation by an experienced
    labor, employment and civil rights litigator:

  • Discrimination on the basis of being a person in a "protected
    class," including race, national origin, ethnicity, religion, age,
    gender, sexual preference, marital status, pregnancy, disability
    (physical or mental), membership and duty in the military;

  • Sexual harassment, or harassment based on membership in a
    protected class. This may be directed specifically at one
    person, done as a hostile work environment, or through
    discriminatory policies and practices. It may take the form of
    unwelcome physical touching, taunts, verbal abuse, offensive
    photos and pictures, ordering a member of a protected class
    to do demeaning tasks that others in his or her job title, but
    not in the "protected class" do not have to do, or denying
    tools of the trade or proper uniforms based on "protected
    class" membership;

  • Retaliation for "whistleblowing" --reporting or opposing
    unlawful discrimination or illegal conduct by an employer;
    for seeking Workers' Compensation benefits; for trying to
    enforce various workplace safety laws; or for engaging in
    union activity;

  • Interference with civil rights, such as speech, religious and
    property rights;

  • Violations of collective bargaining agreement by the
    employer, or a union's failure to represent an employee for a
    legitimate grievance;

  • Wage/hour pay violations, illegal wage-docking, denials of
    severance or other compensation owed under a contract;

  • Pension and other benefits claims;

  • Workplace injuries - "Workers' Compensation" claims;

  • Unemployment Compensation and plant closure/relocation
    assistance claims;

  • Violations of privacy, such as illegal polygraphs, surveillance
    or drug testing of employees, and public dissemination of
    employee's confidential employment and medical records;

  • Defamation, breach of the covenant between employer and
    employee of "good faith and fair dealing," infliction of
    emotional distress;

  • Breach of contract, or "noncompete" agreements or
    agreements not to sue, or that try to stop you from
    cooperating with government investigators.

  • Review of severance offers, employment contracts and
    termination agreements -- before you sign!
